ONLINE GENERAL TERMS AND CONDITIONS OF SALE
ARTICLE 1 – SCOPE OF APPLICATION
All our sales are governed by these general terms and conditions of sale, which prevail over any purchase conditions, except for express derogatory stipulations, and are deemed accepted at the time of the conclusion of the sales contract.
ARTICLE 2 – ORDERS
2-1 Placing and Preparing the Order
Orders are placed after acceptance of these general terms and conditions of sale, either online or by mail at the following address:
Champagne Lanouvelle – SASU Champagne Lanouvelle – 72 rue Cardinet – 75017 Paris – 07.60.03.95.10.
The customer specifies the payment method (credit card or bank transfer).
The order is confirmed upon receipt of payment, which is irrevocable.
The customer receives an email confirming the receipt of the order and the acceptance of the general terms and conditions of sale, which does not constitute an order acceptance.
2-2 Product Unavailability
The seller undertakes to fulfill the order within the limits of available stock. In case of stock shortage, the seller will offer the customer a product of equivalent quality and price. If no agreement is reached, and the customer decides to withdraw, a refund will be processed under the conditions of Article L 121-20-1 of the Consumer Code.
2-3 Right of Withdrawal
According to Article L121-20 of the Consumer Code, the customer has a period of seven full days from the delivery date to exercise their right of withdrawal without justification or penalties, except for return costs, if applicable. The period begins upon receipt of the goods.
If the delivery is refused while Champagne Lanouvelle (SASU) has made no delivery or preparation error and the products are in good condition, the shipping costs will not be refunded upon issuance of a credit note. The return of goods (organization and costs) will be the customer’s responsibility.
If the seven-day period expires on a Saturday, Sunday, or a public holiday, it is extended until the next working day.
ARTICLE 3 – DELIVERY
3-1 Delivery Methods and Timeframes
Orders are shipped via road transport from 12 bottles (and by La Poste for orders of 6 bottles or less).
You will receive your order within **8 business days**.
Orders placed over the weekend or on a public holiday will be processed the next working day.
Delivery times are given in good faith and are purely indicative. Unless expressly agreed otherwise in writing, a delay cannot justify an order cancellation or any compensation.
The products ordered by the buyer will be delivered to the address provided by the buyer as the delivery address on the corresponding order.
If the buyer or recipient is absent, a delivery notice will be left, allowing them to contact the transporter to arrange another delivery date.
If the products are not claimed within **15 business days** from the delivery notice, they will be returned to the seller, and the buyer will be refunded, minus the shipping and return costs.
3-2 Delivery Address
The delivery area for products sold on the website covers mainland France.
3-5 Transport and Risks
The transfer of risks for products sold by Champagne Lanouvelle (SASU) occurs at the time of handing over the products to the transporter.
The recipient must report any damage or missing items to the transporter via a registered letter with acknowledgment of receipt within **3 days** of receipt, as per Article L.133-3 of the Commercial Code. A copy must also be sent to us by fax or registered mail.
Any product that has not been the subject of a claim will be considered accepted, releasing our company from any liability.
ARTICLE 4 – PRICES
All our prices are stated in euros, including all taxes, and are those in effect at the time the order is placed.
For shipments within France, the price includes shipping fees.
For other countries, shipping costs are calculated based on the destination.
Unless otherwise agreed, payment is due upon ordering. No discount will be granted for early payment.
According to legal provisions, any payment made after the due date stated on the invoice will result in late payment penalties equal to three times the legal interest rate. These penalties are due automatically without prior notice.
